These Terms of Service constitute a legally binding agreement between you and Smart Website Pro, a brand of Get Amplified Marketing, governing your access to and use of our website, services, AI-powered systems, and related offerings. By accessing our website or using our services, you agree to be bound by these Terms.

AI-POWERED SERVICES

By using our services, you acknowledge and agree that:

• AI systems will interact with your customers on your behalf
• AI-generated responses are based on information you provide
• AI systems may make automated decisions
• AI performance depends on the quality of information provided

AI systems may occasionally produce inaccurate responses and are not a substitute for professional advice.

SUBSCRIPTION AND BILLING

Smart Website Pro services are provided on a month-to-month subscription basis:

• No long-term contracts required
• 30-day free trial for new customers
• Cancel anytime with 30 days notice
• Monthly fees are billed in advance

Usage-based fees may apply for AI voice agent usage, phone services, SMS messaging, and email sending beyond included limits.

FEES AND PAYMENT

Fees are outlined in your service agreement. Usage-based fees may apply for:

• AI voice agent usage (inbound and outbound calls)
• Phone and telephony services
• SMS and text messaging
• Email sending and AI chat interactions

Payment is due within 15 days of invoice date unless otherwise specified.

CLIENT RESPONSIBILITIES

As a client, you agree to:

• Provide accurate and complete business information
• Respond to requests for information in a timely manner
• Review and approve content before publication
• Maintain valid payment information on file
• Comply with all applicable laws and regulations
• Not use services for any unlawful purpose

INTELLECTUAL PROPERTY

Upon full payment, you own the content created specifically for your business, including website copy and blog articles. We retain ownership of:

• Our proprietary systems, templates, and frameworks
• AI models and algorithms
• Software and code underlying our services

DISCLAIMERS

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE SPECIFIC RESULTS INCLUDING SEARCH ENGINE RANKINGS, LEAD VOLUME, CONVERSION RATES, OR RETURN ON INVESTMENT.

Marketing results depend on many factors outside our control, including market conditions, competition, and your business operations.

LIMITATION OF LIABILITY

OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF BUSINESS OPPORTUNITIES.

INDEMNIFICATION

You agree to indemnify and hold harmless Smart Website Pro, Get Amplified Marketing, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.

TERMINATION

Either party may terminate services with 30 days written notice. Upon termination:

• Access to services will be discontinued
• Any outstanding fees become immediately due
• You may request a copy of your website content and data
• We may delete your data after 30 days unless otherwise required by law

GOVERNING LAW

These Terms are governed by the laws of the State of Wyoming without regard to conflict of law principles. Any dispute arising from these Terms or your use of our services shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website. Your continued use of our services after such changes constitutes acceptance of the new Terms.
